We study how patent-exhaustion doctrine shapes global production networks. In a North-South model with a competitively supplied patented intermediate, we contrast presumptive international exhaustion (PIE)—which allows patentees to reserve domestic rights via contractual restrictions (CRs)—with absolute international exhaustion (AIE), which bars such reservations. PIE enables geographic price discrimination but exposes offshoring firms to litigation risk; AIE eliminates legal uncertainty and, in integrated markets, leads to uniform licensing and pricing. We show: (i) firms’ sourcing choices yield a dual-rationale CR equilibrium—rent-preserving at low cost shares and litigation-driven at high—while patentees may optimally relax CR enforcement at intermediate shares to expand licensing volume; (ii) shifting to AIE expands offshoring, compresses price dispersion, and reallocates surplus toward Northern consumers; and (iii) patentees generally prefer PIE, although high-input-share firms may favor AIE when litigation exposure outweighs price-discrimination rents. These mechanisms yield testable implications by intellectual-property intensity, arm’s-length sourcing, and value-chain position, consistent with post-Lexmark import patterns.

Dr. Olena Ivus is the Associate Dean (Graduate Programs), an Associate Professor (with tenure) and E. Marie Shantz Fellow of Business Economics at Smith School of Business, Queen's University.

Her research focuses on international trade, intellectual property protection, and inventor migration, employing both theoretical and empirical approaches. Dr. Ivus's work has been published in leading academic journals, including the Journal of International Economics, Canadian Journal of Economics, Journal of International Business Studies, and Research Policy.

At Smith School of Business, Dr. Ivus teaches in multiple programs, including Graduate (MSc and PhD), Master of Finance (Beijing and Toronto), and Full-time MBA. In addition to her academic role, Dr. Ivus serves as a Senior Fellow at the Centre for International Governance Innovation (CIGI), where she contributes to policy discussions and research on global economic governance.

Dr. Ivus holds a PhD in Economics from the University of Calgary, which she completed in 2009.
